 GENERAL CONDITIONS

 

SOLINET Complies to the General Conditions recommended by the Zentralverband Elektrotechnik - und Elektroindustrie (ZVEI) e.v from June 1997.

 

SOFTWARE LICENSE AGREEMENT

 

BY INSTALLING SOLINET SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS, AND THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF AGREEMENT BETWEEN YOU AND SOLINET AND SUPERSEDES ANY EARLIER AGREEMENT, WHETHER VERBAL OR WRITTEN. IF YOU DO NOT ACCEPT THIS AGREEMENT YOU SHOULD PROMPTLY RETURN THE UNOPENED PACKAGE CONTAINING THE SOFTWARE, DOCUMENTATION AND PACKAGING TO THE PLACE OF PURCHASE FOR A REFUND OF THE AMOUNT PAID.

 

GRANT OF LICENSE

 

This SOLINET license agreement grants you the right to install and use the accompanying software on the class of computer hardware by the number of people for which the corresponding fee has been paid.

 

COPYRIGHT

 

The software and accompanying documentation are copyrighted. You may not copy the documentation. You may copy the software for the number of computers defined plus one copy solely for backup or archival purposes. You may not (a) electronically transfer the software over a network without a recognized license control mechanism limiting the use of the software; (b) distribute, rent, lease or grant copies of the software or their documentation to others; (c) modify, adapt, translate, reverse translate, decompile, disassemble or create derivative works based on the software or the documentation without the prior written consent of SOLINET and stating the source of the copyrighted material; (d) ship or transmit, directly or indirectly, any copies of the software in contradiction of any laws restricting distribution.

 

LIMITED WARRANTY

 

SOLINET warrants the recorded medium for a period of 30 days from the date of purchase, during which time you may obtain a replacement in the event of material defects from the place of purchase. SOLINET disclaims all other warranties; either expressed or implied, with respect to the software, documentation and suitability for a particular purpose. Due to the complex nature of computer software, SOLINET does not warrant that the software is completely error free, will operate without interruption, or is compatible with all equipment and configurations.

 

LIMITATION OF LIABILITY

 

SOLINET shall not, under any circumstances and without limitations, be liable for any direct, indirect, consequential to incidental damage to you or any other party arising out of the use of, or inability to use the software.

 

DURATION OF AGREEMENT

 

This license agreement is effective from the moment you open the sealed disk package or download the software until terminated. You can terminate it by destroying the software and documentation, or by transferring this license agreement to another party, in which case the other party must agree before the transfer to be bound by the terms and conditions of this license agreement.

 

SALVATORY CLAUSE

 

Should any part of this agreement be invalid for any reason, it is to be replaced with a corresponding text, which is valid and equivalent to the intended meaning. The rest of the agreement shall remain unaffected and valid.
